Partner Terms

These terms govern the relationship between Aljubarrota — Comércio & Serviços, Lda. (‘humidade.pt’, ‘we’) and the companies that receive customer requests through humidade.pt (the ‘Company’). The final section contains the data-sharing agreement.

In short

  • You only pay for the requests you receive: class A €35, class B €15, plus VAT. Exclusive requests cost ×1.8. Your first 5 requests are free.
  • Each request goes to no more than 2 companies. There are no paid placements: what counts is the area, type of work, customer ratings and response time.
  • You can dispute a request within 72 hours for a wrong number, wrong area or duplicate. ‘Customer not interested’ is not a reason for a refund.
  • You agree to contact the customer within 24 working hours. An average below 3.5 after 5 ratings leads to a pause and review.
  • Customer data may be used only to respond to the request: it may never be resold and is deleted after 24 months.
  • No lock-in: you can stop receiving requests whenever you like. (to be validated)

01Purpose, parties and acceptance#

humidade.pt is an independent damp diagnosis service. When a customer asks for quotes and gives consent, we send the request to no more than 2 partner companies, which pay us for each request received, under these terms.

These terms are intended only for companies and professionals acting in the course of their business; they do not apply to consumers.

They are accepted online at registration, and the date, time and version accepted are recorded (current version: 2026-10-v1). In the event of conflict, the following prevail in this order: (1) the data-sharing agreement (section Data-sharing agreement); (2) these terms; (3) the site’s general Terms and Conditions.

02Registration and validation#

When registering, the Company provides: trading name and legal name, tax number (NIF), email, phone, contact person, website (optional), the municipalities where it works and the types of work it does.

  • We check the NIF and the declared activity. We may ask for the permanent company certificate (certidão permanente), the licence or certificate required for the activity and the public liability insurance policy. (to be validated)
  • Until validated, the account is ‘pending’ and receives no requests. Once validated, we send an email to set the dashboard password.
  • We may refuse registrations that do not meet our quality and independence criteria — for example, companies that sell treatments without a diagnosis or have serious complaints.
  • The account belongs to the Company and may not be transferred. The Company is responsible for keeping its credentials secure, for everything done with them and for keeping its details up to date.

03How requests are assigned#

Assignment is done by an algorithm, without commercial intervention. A request can only be assigned to companies that:

  • are active and cover the customer’s postcode (through the municipalities or postcode prefixes configured);
  • do the type of work needed for the likely cause or the service requested;
  • accept exclusive requests, in the case of exclusive requests;
  • have not reached the weekly request limit they have set;
  • have enough balance, free pilot requests or active monthly invoicing.

Among eligible companies, the order depends on the customers’ average rating, the average response time and rotation (whoever received a request longest ago moves up). Each request is sent to no more than 2 companies (or 1 if exclusive).

It is not possible to pay for priority. We do not guarantee a minimum number of requests: volume depends on demand in your area.

04Classification and prices#

Each request is classified automatically when the customer sends it:

Prices exclude VAT, which is added at the legal rate in force (currently 23%). (to be validated)

Each request includes the diagnosis report, photos, postcode prefix and region, class, timeframe, type of service and the customer’s contact details. The price is charged at the time of assignment and shown in the dashboard and in the notification email.

We may revise prices or criteria with at least 30 days’ notice by email. Changes do not apply to requests already assigned.

05Pilot#

Your first 5 requests are free, with no commitment. If a dispute about a free request is accepted, the request counts as free again. After the pilot, the Company chooses how to pay in order to keep receiving requests.

06Billing and payment#

Prepaid balance

  • Top-ups from €150, by bank transfer or another method shown in the dashboard. [to be confirmed]
  • Each request is deducted from the balance at the time of assignment. We email you when the balance falls below the price of a class A request.
  • Without enough balance, the Company stops receiving requests until it tops up.

Monthly invoice

  • Available on request after 3 consecutive months with no late payments.
  • At the start of each month, we invoice the requests assigned in the previous month, less accepted refunds. Payment within [to be completed] days of the invoice date. (to be validated)
  • In the event of late payment, we may suspend requests and switch back to prepaid balance, and late-payment interest is due at the legal rate for commercial transactions (Decree-Law No. 62/2013). (to be validated)

Invoices

We issue invoices with VAT at the legal rate using invoicing software certified by the Portuguese Tax Authority, sent to the account email. Balance transactions are always available in the dashboard.

07Disputes and refunds#

The Company may dispute a request in the dashboard within 72 hours of receiving it, for one of these reasons:

  1. wrong number, or no answer after 3 attempts within 48 hours, on different days and at different times;
  2. outside the area or type of work configured by the Company;
  3. duplicate: the same customer had already sent a request in the previous 30 days.

The following are not reasons for a refund: the customer not being interested, choosing another company, finding the price too high, having already solved the problem, or no longer answering after a successful first contact.

  • We review each dispute and reply by email, normally within 5 working days. (to be validated) We may ask for evidence of the contact attempts.
  • If accepted, the amount goes back to the balance (or is credited on the next invoice) or, during the pilot, the request counts as free again.
  • Systematic unfounded disputes may lead to the account being suspended.

08The Company’s obligations#

The Company agrees to:

  • contact the customer within 24 working hours of receiving the request (counted on working days);
  • identify itself at the first contact and say that it received the request through humidade.pt;
  • update the request status in the dashboard (contacted, visit, quote, contract or lost) and enter the diagnosis confirmed on site, which we use to calibrate the model;
  • give clear, written quotes, without charging the customer for the contact and without aggressive or misleading commercial practices;
  • comply with the law applicable to its activity, in particular consumer protection, pre-contractual information, guarantees, invoicing, licensing and Complaints Book rules;
  • not contact the customer about matters unrelated to the request;
  • not present itself as certified, recommended or rated by humidade.pt beyond being a partner.

09Quality and ratings#

About 30 days after each request, we ask the customer to rate the company that contacted them from 1 to 5. The average rating and response time affect the order of assignment.

  • Average below 3.5 after 5 ratings: the account is automatically paused and reviewed. After the review, we may reactivate it, with or without conditions, or exclude it.
  • Customer complaints, repeated failure to respond or false information in the dashboard may also lead to a pause or exclusion.
  • The Company may give its side of the story before any exclusion decision.

10Exclusive requests#

The Company may choose to accept exclusive requests, which are sent to it alone. They cost the class price ×1.8 and follow the same dispute rules. If the Company does not contact the customer within 24 working hours, we may send the request to another company. (to be validated)

Exclusive requests do not grant territorial exclusivity: no area is reserved for a single company.

11Data-sharing agreement (annex)#

This annex governs the sharing of customers’ personal data between humidade.pt and the Company, under the GDPR and Portuguese Law No. 58/2019. (to be validated)

1. Role of the parties

humidade.pt and the Company are independent controllers: each decides on its own processing and is responsible for complying with the law. They are not joint controllers and there is no processor relationship.

2. Data shared and legal basis

Name, mobile, email (if given), diagnosis report, photos, postcode prefix, timeframe, type of service and whether the customer owns or rents. Sharing is based on the customer’s explicit consent. Processing by the Company is based on steps taken at the customer’s request prior to entering into a contract (Article 6(1)(b) GDPR).

3. Purpose limitation

The Company may use the data only to contact the customer about the work requested and to prepare and perform the quote or contract. It is forbidden to:

  • sell, transfer, rent or share the data with third parties, except the Company’s own processors bound under Article 28 GDPR;
  • use the data for advertising, newsletters or contacts about other services without the customer’s own, separate consent;
  • add the data to databases for other purposes or build profiles.

4. Informing the customer

At the first contact, the Company identifies itself, states that it received the data through humidade.pt and makes its own privacy information available (Article 14 GDPR).

5. Retention

The Company deletes the data within 24 months at most of receiving it, or sooner if the customer asks or withdraws consent — unless it has entered into a contract with the customer or the law requires it to keep the data, and only to the extent necessary.

6. Security and confidentiality

The Company applies appropriate technical and organisational measures (Article 32 GDPR), limits access to the people who need the data and ensures they are bound by confidentiality.

7. Data breaches

The Company notifies humidade.pt at privacidade@humidade.pt without undue delay and within 72 hours at most of becoming aware of a breach affecting data received through us, and cooperates in resolving it. Each party is responsible for the notifications to the CNPD and to data subjects that fall to it.

8. Data subject rights

Each party handles the requests addressed to it and forwards to the other, within 5 working days, those that concern the other. When we notify that a customer has withdrawn consent or asked for erasure, the Company stops using the data and deletes it within 5 working days, unless a contractual relationship with the customer already exists. 9. Transfers and processors

The Company does not transfer the data outside the European Economic Area without the safeguards of Articles 44 et seq. GDPR and only uses processors that provide sufficient guarantees.

10. Proof of compliance and liability

On request, the Company demonstrates compliance with this annex. Each party is liable for the damage it causes by breaching the law or this annex; the Company indemnifies humidade.pt for losses resulting from misuse of the data it receives. Breach of this annex allows the account to be suspended immediately. These obligations survive the end of the contract for data already received.

12Suspension and termination#

  • The Company may stop receiving requests or end the contract at any time by emailing parceiros@humidade.pt, with no penalty. (to be validated)
  • We may suspend the account immediately in the event of late payment, breach of the data-sharing agreement, application of the quality rule, serious complaints, false information or abuse of disputes.
  • We may end the contract without cause with 30 days’ notice, or immediately in the event of a serious breach.
  • When the contract ends, we refund any unused prepaid balance within 30 days, less any amounts owed (to be validated); outstanding invoices remain payable and data obligations continue.

13Liability#

We pass on contact details as the customer entered them, and the diagnosis is indicative. We do not guarantee that the customer will hire anyone, or a minimum volume of requests. The Company is solely responsible for its quotes, work and relationship with the customer, and indemnifies humidade.pt against third-party claims resulting from its breaches.

Except in cases of wilful misconduct (dolo) or gross negligence, our liability to the Company is limited to the amount it paid us in the 12 months before the event giving rise to it. (to be validated)

14Use of the brand#

While active, the Company may state that it is a ‘humidade.pt partner’, without suggesting that its work is certified or guaranteed by us. Any other use of the brand requires written permission.

15Changes#

We may change these terms with at least 30 days’ notice by email. If the Company does not agree, it may end the contract without penalty before the changes take effect. Changes required by law may apply sooner.

16Notices, governing law and jurisdiction#

Notices are given by email: to the Company, at the account email; to us, at parceiros@humidade.pt (or privacidade@humidade.pt for data matters).

These terms are governed by Portuguese law. The courts of the district of [to be completed] have exclusive jurisdiction over any dispute. (to be validated)

This is a translation. If there is any discrepancy between this version and the Portuguese version, the Portuguese version prevails.
